1. Introduction and Acceptance of Terms
GenCash Fintech (hereinafter the “Company”, “we”, “us”, or “our”) provides financial technology and digital payment services through its website and planned mobile applications (collectively the “Platform”). By accessing or using the Platform in any way (including browsing or transactions), you (“you” or “User”) agree to these Terms of Use and Privacy Policy (“Terms”). These Terms constitute a binding agreement under applicable law (including the Information Technology Act, 2000). If you do not agree to all terms, you must immediately cease using the Platform.
We may update or modify these Terms from time to time. We will post the updated date at the top and may notify you via the Platform or by email. Your continued use of the Platform after changes are posted means you accept the revised Terms. It is your responsibility to review these Terms periodically. Certain supplemental policies or rules may be posted on the Platform (e.g., Acceptable Use Policy, Merchant Guidelines). These are part of and governed by these Terms by reference.
2. Eligibility and Registration
You may use the Platform only if you are legally competent to contract (e.g. at least 18 years of age under the Indian Contract Act) and not barred under law. Minors (under 18) may use the Platform only with the consent and supervision of a parent or legal guardian. You confirm that you have the right, authority and capacity to accept these Terms on behalf of yourself (or any entity on whose behalf you act).

Registration: To access certain services, you must register for an account (“Account”) on the Platform. You agree to provide true, accurate, current and complete information during registration and to update it promptly as needed. If any information you provide is false or incomplete, the Company may suspend or terminate your Account without liability.

Documentation: For registration or compliance, you may be required to submit identity, address, or bank account documents (e.g. PAN, Aadhaar, passport, debit/credit card details) and pass verification. You authorize us to verify this information as needed.

Account Security: You are responsible for maintaining the confidentiality of your login credentials (username, password, secret key, etc.) and for all activities under your Account. You must immediately notify us of any unauthorized use or breach of security. Always log out after using the Platform to prevent unauthorized access. We are not responsible for losses due to your failure to keep credentials secret or to log out. If you forget your password, we may send a new one after verifying your identity; you must change it upon receipt.
3. Description of Services
GenCash Fintech provides digital payment and financial services, including but not limited to money transfers, merchant payment acceptance, bill payments, account management, and related fintech solutions. Our Platform may include web and mobile applications. We strive to deliver these services in a friendly, efficient and secure manner, ensuring customer satisfaction.

Scope: We may partner with banks, financial institutions and other providers to offer services (“Third-Party Services”). You acknowledge that third-party services are provided “as is” and we do not guarantee their content or functionality.

Mobile App: The Platform currently includes a website, and we intend to launch mobile applications in the future. These Terms apply to all Platform forms.
4. Customer Obligations and Account Use
By using the Platform, you represent and warrant that all information you provide is accurate, current and complete . You agree to use the services for lawful, authorized purposes and to comply with all applicable laws (e.g. Anti-Money Laundering, Income Tax laws). Transactions must only be made from bank accounts or cards lawfully belonging to you. You must not use the Platform to violate any law or facilitate any wrongdoing.

Updates: You must promptly inform us of any change in your personal details or status that may affect your Account (for example, change of address, contact, KYC status).

Authority: If you register or use the services on behalf of an entity (business or other legal person), you represent that you have full authority to bind that entity to these Terms.

Expenses: You shall be responsible for any fees associated with using the Platform (e.g. internet or data charges). Any fees of third parties (such as your bank or telecom provider) are your responsibility.
5. Prohibited Uses and Content
You may not use the Platform or services for any unauthorized or illegal purposes. Without limiting the foregoing, you agree NOT to:

Violate any law, regulation or third-party rights in India or elsewhere; facilitate or participate in fraud, money laundering, terrorist financing or any criminal activity.

Use the Platform in a commercial manner not expressly approved by us. Systematically scrape, mine or collect data from the Platform for unauthorized purposes.

Impersonate any person or entity, or misrepresent your affiliation with any person or entity. Transmit any harmful code, viruses or similar malicious software.

Harvest or collect information of other users (e.g., via robots, “spiders”, “bots”).

Hack, password-mine or attempt unauthorized access to any part of the Platform or its networks. Circumvent any security or usage restrictions of the Platform.

Disclose, reproduce or distribute any Platform content in violation of intellectual property restrictions.

Violate any content guidelines (for example, you must not upload or share defamatory, obscene, infringing, hateful or illegal content).
We reserve the right to investigate and take legal action (including referral to law enforcement) if you violate these rules. We may terminate your access if you engage in prohibited conduct.
6. Communications and Consent
By creating an Account, you consent to receiving communications from us by email, SMS, telephone or in-app messages as part of normal service operation . These may include transaction alerts, notifications, marketing messages and surveys. You can opt out of marketing communications (promotions or newsletters) at any time by following the unsubscribe instructions in such messages or contacting us at sales@gencashfintech.com. However, you cannot opt out of essential service communications (such as payment confirmations or security alerts) necessary for account management.

Consent: By providing personal data (including by using the Platform), you expressly consent to its collection, use and disclosure in accordance with this policy. You may withdraw consent at any time (see Section 9 below).

Third-Party Platforms: From time to time we may communicate through or link to third-party websites or apps. You acknowledge and agree that any interactions with third parties (e.g. other users in a chat or payments through a partner) are at your own risk, and we do not control or endorse their content or conduct.
7. Privacy Policy
Information Collection:
We collect and process the following types of information about you:

Personal Information: This includes data you provide during registration or profile setup (such as name, address, email, phone number, date of birth), financial details (bank account, debit/credit card details), identification documents (PAN, Aadhaar, passport, etc.), transaction details and payment history, and any correspondence or feedback you send us.

Traffic and Technical Data: We automatically collect data when you visit or use the Platform, such as IP address, device information, browser type, operating system, location data, pages viewed, and usage patterns.

Communication Records: Details of your communications with us (calls, emails, chat messages) and any cookies or tracking data from your device.

Third-Party Information: We may obtain information from third-party sources (e.g. credit bureaus, fraud prevention agencies) for verification, anti-fraud and compliance purposes.
Use of Information: We use your information for the following purposes:

To operate, maintain and administer your Account and to provide the services you request, including completing transactions (verifying funds, processing payments).

To comply with legal and regulatory obligations (e.g. KYC, anti-money laundering, tax reporting), and cooperate with law enforcement or regulators when required.

To communicate with you about your Account, updates to services or policies, and marketing offers if you have consented.

For customer support, fraud detection, and to protect the security and integrity of the Platform.
We handle and store data in compliance with applicable data protection and financial regulations. Sensitive information (e.g. passwords, PINs) is stored only in securely hashed/encrypted form, or not stored at all.
Data Sharing and Disclosure: We will not sell or rent your personal information. We may share your information with third parties only as follows:

Service Providers: We may share necessary information with third-party vendors who perform services on our behalf (e.g. payment processors, IT and security providers, analytics firms, mailing services), subject to confidentiality obligations. These providers may only use your data to provide services to us and not for their own use.

For example, transaction and KYC data may be kept for a minimum of five years (per financial regulations). After the retention period, your personal information will be securely deleted or anonymized.
8. Consent Withdrawal and Your Data Rights
You have the right to withdraw your consent to processing of personal data, to the extent we rely on consent. To do so, contact us at sales@gencashfintech.com from your registered account email, clearly stating your request. We will act on your request promptly (typically within 1–2 business days) and confirm its completion.

Consequences: Upon withdrawal, we will cease processing data for the consented purposes. You will no longer receive services or communications tied to the withdrawn consent, and certain features may be disabled. Data processed before withdrawal may remain in our records if required by law.

Record-Keeping: We will document all consent withdrawals and handle them in accordance with applicable regulations.

Access and Correction: You may access, correct or update your personal information at any time by logging into your Account or contacting our support. We will respond to such requests in a timely manner.
9. Disclaimers, Indemnity, and Limitation of Liability

No Warranties: Except as expressly provided, the Platform and services are provided “AS IS” and “AS AVAILABLE” without any warranty of any kind, whether express, implied or statutory. We disclaim all warranties including fitness for a particular purpose, accuracy, completeness, or non-infringement. We do not guarantee uninterrupted or error-free operation, and we are not responsible for delays, failures or data loss caused by factors beyond our control (e.g., network issues, device failures).

Limitation of Liability: To the fullest extent permitted by law, the Company (and its officers, directors, employees, agents and partners) will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of (or inability to use) the Platform . This includes loss of profits, business interruption, or data loss, even if we have been advised of the possibility of such damages. Our total liability for any direct damages shall not exceed the amount you paid (if any) for the service giving rise to the claim.

Indemnification: You agree to indemnify and hold the Company and its affiliates, officers, directors, employees and agents harmless from any claims, losses, damages, liabilities, costs or expenses (including legal fees) arising out of your breach of these Terms or your misuse of the Platform . This includes any violation of law or third party rights by you, or claims related to your content or transactions. You must promptly notify us of any such claim and cooperate in its defense.

Waiver and Severability: Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right. If any part of these Terms is found to be invalid or unenforceable under applicable law, that provision will be deemed omitted, and the remainder of these Terms will continue in full force.
10. Intellectual Property Rights
All content on the Platform (including but not limited to text, graphics, logos, images, software, audio, video and designs) is owned by GenCash Fintech or its licensors and is protected by copyright, trademark, patent and other intellectual property laws. The Company grants you a limited, nonexclusive, non-transferable license to access and use the Platform for its intended purposes.

You may use the content only for your personal, non-commercial use. Except as expressly permitted, you may not reproduce, copy, republish, upload, post, distribute, translate, create derivative works from, or otherwise exploit any content on the Platform.

All trademarks, service marks and logos used on the Platform are the property of their respective owners. You are not granted any right or license to use them.
11. Governing Law and Dispute Resolution
These Terms and your use of the Platform will be governed by the laws of India . Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in [Mumbai, India] (or another location as required by law), and each party consents to such jurisdiction.

Arbitration (Optional): In the event of any dispute that cannot be resolved through mutual discussions within 30 days, the matter may be submitted to arbitration in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in [Mumbai] in English (if applicable). Judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction.

13. Miscellaneous

Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations to affiliates or successors at any time.

Entire Agreement: These Terms (including our Privacy Policy and any policies referenced herein) constitute the entire agreement between you and the Company regarding the Platform, superseding any prior agreements.

Future Expansion: We may introduce additional features (such as mobile applications, new payment products or international services) in the future. These Terms will apply to any such new services, unless otherwise stated.

Disclaimer
By using GenCash Fintech’s Platform, you acknowledge that you have read, understood and agreed to these Terms in full. If any provision of these Terms is invalid under law, that provision shall be deemed omitted and the remainder shall continue to apply.
